FBI: 4 charged with Senator phone tap scheme

AP reports on attempts to interview O'Keefe's "mentor" Ben Wetmore, who had apparently put the feeble four up for a few nights before their botched felony attempts.

Wetmore didn't say much but his roommate Johhny Angel, the front man for the swing band Johnny Angel and the Swinging Demons, was more forthcoming. "Man, it was laptop city in this place," he said referring to O'Keefe, Dai and Basel quietly working away on their computers in the days before Numptygate.

Angel didn't mind the three crashing at the house because they were nice guys. He just had no idea the three, along with a fourth man who lives in New Orleans, would get mixed up in a scheme that would land them in jail on a charge of entering federal property under false pretenses for the purpose of committing a felony.

Their respective trips to New Orleans ended with Angel driving them to the federal courthouse, their suitcases packed, to receive instructions from court officials outlining the conditions of their release. They're free on $10,000 bond and are scheduled to return to court Feb. 12.

Angel said he asked the guys if what the newspaper was saying was true: Did they really try to mess with Landrieu's phones?

"They said they couldn't talk about it, that the judge said they couldn't discuss the case," Angel said.

Angel seems to give credence to the previous reports that the accused were told not to discuss the case, which O'Keefe denied in his statement.

If nothing else, O'Keefe is an idiot for talking about the case while a case is pending. Hopefully he will keep it up and provide more ammunition for the prosecution when he is "put under the kosh" by Hannity.

Mods,
Do you think somebody could merge the two topics. I think the other place is better:

From Fox:

U.S. Attorney Steps Down From O'Keefe Case

FOXNews.com

James O'Keefe, accused of trying to tamper with the phones of Louisiana Sen. Mary Landrieu, was "framed" by the media and the U.S. attorney's office, Andrew Breitbart, publisher of BigGovernment.com, told Fox News Monday.

The same day the man who first published James O'Keefe's explosive videos exposing wrongdoing at community organizer ACORN came to his defense Monday, claiming the conservative filmmaker "sat in jail for 28 hours without access to an attorney" while the prosecutor made his case to the media, the U.S. attorney involved stepped down.

O'Keefe, accused of trying to tamper with the phones of Louisiana Sen. Mary Landrieu, was "framed" by the media and the U.S. attorney's office, Andrew Breitbart, publisher of BigGovernment.com, told Fox News Monday.

Hours later, Jim Letten, U.S. attorney for the Eastern District of Louisiana, recused himself from the case.

Andrew Breitbart is quoted. He also sent out the tweet to this article. He is defending O'Keefe like crazy.

This might disappear if they claim copyright violation. Sometimes Fox will.

Note how he compares what he did with Nightline, Dateline, etc.

ummm... ACORN is NOT a Senator's office. Also, the other shows are often working with law enforcement.

Edit: Adding Part 2. Such the victim he is.

News Hounds' take on Hannity interview...

ACORN videographer and possible felon James O’Keefe appeared on Hannity last night (2/1/10), supposedly to tell his side of the story about his federal arrest for using “false and fraudulent pretense” to enter U.S. Senator Mary Landrieu’s office for the purpose of “willfully and maliciously interfering” with her telephone system. It’s hard to know what O’Keefe thought he might accomplish on the show. Though he claimed the whole situation was “a misunderstanding,” he refused to answer what, exactly, he and his three cohorts had been trying to accomplish by dressing up as telephone repair people and what, exactly, they had been trying to do with the telephones. He also never said he was innocent of any crime. However, much of what O’Keefe did say strained credibility, to say the least. Sean Hannity, though obviously sympathetic to O’Keefe, did a reasonable job of trying to find out what happened in Landrieu’s office but gave O’Keefe a complete pass on everything that did not add up.

More at the link.

O'Keefe, whilst generally happy to discuss details, had a predictable criterion for deciding where he "could not discuss matters because of the ongoing investigation" - I believe it was a reference to the 5th Amendment.

I got the impression that Hannity was leaving himself enough wiggle room to go either way depending on how this pans out.

Before Caper, O'Keefe And Co. Crashed At House Of Activist 'Mentor'
Justin Elliott | February 1, 2010, 11:12AM

A 28-year-old Loyola law school student and conservative activist named Ben Wetmore has emerged as the Fifth Beatle of the Landrieu phone-tampering case.

Wetmore, who hired alleged phone tamperer James O'Keefe at the Leadership Institute a few years back to help launch conservative media outlets on college campuses, this month offered up his New Orleans house as a crash pad for O'Keefe and co-defendants Joseph Basel and Stan Dai, the New York Times reports.

The Leadership Institute is a conservative group dedicated to fostering alternative newspapers on college campuses -- including the papers of two of the four defendants in the Landrieu case.

The AP has the details on Wetmore and on how the four defendants spent their days in New Orleans before the Landrieu episode, down to the drinks each ordered while watching the Saints win the NFC Championship on Jan. 24 ("Dai preferred Maker's Mark bourbon ...").

Breitbart Claim: Jailed O'Keefe Couldn't Access Attorney For Hours
Justin Elliott | February 1, 2010, 2:21PM
Interviewed on Fox just moments ago, Andrew Breitbart claimed that alleged Landrieu phone tamperer James O'Keefe "sat in jail for 28 hours without access to an attorney."

Breitbart, who has been on a public campaign defending O'Keefe, a paid contributor to Breitbart's BigGovernment.com, also charged that the U.S. Attorney's office in Louisiana leaked information to the press "helping" them to frame the episode as "Watergate Junior."

Breitbart complained that after the news of the arrests broke last Tuesday, O'Keefe's attorney and Breitbart himself were being called by the media but they could not locate O'Keefe -- "and that's because he was sitting in jail without access to an attorney," Breitbart said.

He accused the U.S. attorney of leaking information to the media in a "concerted effort" to frame the episode in a way that would put O'Keefe in a bad position.

Asked by Fox's Megyn Kelly what motivation the U.S. Attorney would have to make such an effort, Breitbart responded: "Well, it's tied to the Justice Department. And we've been very aggressive in asking Eric Holder to investigate what's seen on the ACORN tapes, and he's ignored it."

Max Blumenthal at Salon posts about ace "investigative journalist" James O'Keefe's Race Problem detailing his dalliances with anti-Semites, professional racists and proponents of Aryanism. It also includes this titbit...

O’Keefe lost his job at the Leadership Institute in 2008 for a prank call he made to an Ohio-based Planned Parenthood clinic. During the call, O’Keefe offered a donation to the clinic on the condition that it would be earmarked to pay for aborting African-American fetuses. “Because there's definitely way too many black people in Ohio,” O’Keefe remarked to the receptionist. “So, I'm just trying to do my part.”

This is the guy who his boss Andrew Breitbart called one of the all-time “great journalists” and said he deserved a Pulitzer for his undercover ACORN video, whilst Fox News’ Bill O’Reilly declared he should have earned a “congressional medal.”

OTOH Dave Weigel posts

I’m curious to see what Breitbart goes after — I was at the 2006 event that leads Blumenthal’s story and can confirm all the details about it.

Edit: Notwithstanding that "all the details " post Dave has clarified his position.

About James O’Keefe and That Robert Taft Club Event

Apparently, the One People’s Project is citing me as a corroborating source on the event — but there are aspects of their story I can’t confirm. While their photo of O’Keefe is definitely from the event, I took it on the photographer’s word that O’Keefe was pictured “as he maintained a literature table near the panelists.” I can personally confirm that he was there, but not that he was manning the table — nor that O’Keefe “planned” the event (as Blumenthal put it) with Marcus Epstein, who was president of the Robert Taft Club.

From Dave Weigel:

Blogger Adam Shriver argues that the video reveals the activists to be “jerks” who moved conspiratorially around a rally protesting the Catholic Church’s donations to an anti-gay marriage initiative. I’m just wondering what Basel was doing there. We know that O’Keefe was in St. Louis on November 28 to speak at a Tea Party rally. But here we see O’Keefe and Basel working together — on an apparently unsuccessful project — long before New Orleans.

http://washingtonindependent.com/77441/ ... arly-years

Description from YouTube:
Jame's O'Keefe and Joseph Basel, two of the teabuggers arrested in New Orleans in Senator Landrieu's office, attempt to restrict the free speech of the LGBT community at a rally.

From the St. Louis Activist Hub blog:

Well, I have a video via my friend Ed Reggi from November 29 that I hope puts to rest all of these claims that O'Keefe is simply a nice young man fighting against the oppressive forces of socialism. James O'Keefe, while he was in town to speak at a St. Louis Tea Party rally, attended a Show Me No Hate Rally organized by people protesting the local Catholic Church's donation of thousands of dollars to oppose gay marriage. No "oppressive forces" here. No "corruption." Just a group of people fighting for their rights. Even if someone didn't agree with them, you certainly would agree that they have a right as Americans to express their beliefs. But even to a group of people just standing up for their rights, O'Keefe and Basel are total jerks:

Clearly, O'Keefe and Basel were ignoring the crowd's request for them to stand behind the line. In fact, the police had told everyone to stand behind the line. Even more ridiculous, O'Keefe and Basel tried to pretend that they were still "undercover" even after everyone knew who they were. Furthermore, several people at the rally saw O'Keefe's group write "free abortions" on one of the signs in an attempt to distort the protesters' message. These "champions of free speech" spent their time maliciously trying to interfere with another group of peoples' right to express themselves.

http://stlactivisthub.blogspot.com/2010 ... -nice.html

"jerks". Yeah, but I used different words when I tweeted it out.

Go figure. It was found that ACORN did nothing illegal. They were so badly damaged they had to disband as an organization. Congress even defunded them, until they sued.

Meanwhile, these guys will get nothing but a slap on the wrist. And then, the conservatives will again shower them with praise and awards.

Damned liberal media.

Charges Reduced in Phone Caper at Senator's Office
Looks as if they'll plead to a misdemeanor, i.e., entering a federal building under false pretenses.

I have to admit I'm disappointed, but I have to trust the judicial system to work.....

Not sure what emoticon to put there. I'm sincere, even while acknowledging that corruption and influence exist.

The arc of history turns toward justice.

James O'Keefe and friends plead guilty in Mary Landrieu office caper
By Ramon Antonio Vargas, The Times-Picayune
May 26, 2010, 10:42AM

The four defendants who were arrested in January in Sen. Mary Landrieu's office in the Hale Boggs federal complex in New Orleans pleaded guilty Wednesday morning in federal court to entering real property belonging to the United States under false pretenses.

Magistrate Judge Daniel Knowles III sentenced Stan Dai, Joseph Basel and Robert Flanagan each to two years probation, a fine of $1,500 and 75 hours of community service during their first year of probation.

James O'Keefe, as leader of the group and famous for posing as a pimp in ACORN office videos, received three years of probation, a fine of $1,500 and 100 hours of community service.

Each of the defendants made a statement to the court. They said they did not intend to commit a crime They also apologized for the inconvenience they caused security workers at the federal building.

Remainder:
http://www.nola.com/crime/index.ssf/201 ... plead.html

So, no consequences for them. Those fines mean nothing. They peaded to a misdemeanor. In fact, they are heroes to the RW.
